Black Haitian Ex-FAA Employee Fails With Bias, Harassment Claims – Bloomberg Law

Some of a Black Haitian worker’s job discrimination allegations failed because he was too late with his failure-to-train claim and didn’t tie the alleged harassment to his race, color, or national origin, the Second Circuit affirmed Thursday.
Jean-Claude Tassy was accepted into a Federal Aviation Administration aviation safety inspector training program in Farmingdale, N.Y., and quickly passed the first two levels of training. But Tassy “got stuck” at the third and final level, which required him to demonstrate competency in the job’s duties on his own, under the observation of a trainer, the court said.
