Black Haitian Civilian Army Worker's Bias Suit Revived on Appeal – Bloomberg Law

The US Army will face a Black Haitian civilian worker’s racial and retaliatory harassment claims, after the Fourth Circuit clarified that the same standard to show retaliation applies to private and federal workers.
Alleged comments “summoning an odious trope about African American speech patterns,” connecting the abuses of slavery to athletic abilities, and otherwise reflecting “an overtly racial tenor” stated a plausible discriminatory job harassment claim against the US Army, the US Court of Appeals for the Fourth Circuit said, reversing a lower court.
